3.1 Free editorial content (www.exploremallorca.es)
The website www.exploremallorca.es offers informative and editorial content about activities, points of interest, gastronomy, accommodation and tourism in Mallorca. This content is freely and freely accessible to all users.
The Website may include links to external third-party platforms (such as Tiqets or other activity and tourist experience platforms) where the User can purchase tickets or book activities. Such links are merely access to services provided by third parties; the owner of the Website does not act as a tour operator or intermediary in the contracting of said activities. See clause 6 on affiliation.
3.2 Interactive Map of Mallorca (map.exploremallorca.es)
The website map.exploremallorca.es makes available to users an Interactive Map of Mallorca that compiles and classifies tourist points of interest, routes, beaches, restaurants, accommodation and other resources on the island.
The Interactive Map has two levels of access:
-
Free access (preview): The User can access a limited version of the Map with a reduced number of visible layers and points of interest, without the need for registration or payment.
-
Full access (paid): Upon payment of the applicable fee, the User gains unlimited access to all layers, filters and features of the Interactive Map for the corresponding period, as set out in clause 4.
The Interactive Map is developed on the technological platform of Zoneatlas Oy (Finland), and uses cartography from OpenStreetMap (© OpenStreetMap contributors, ODbL licence) and MapTiler (© MapTiler AG). The owner of the Website is not responsible for the functioning of said technological platform, without prejudice to what is established in clause 9.
4. Purchase and payment for the Interactive Map
4.1 Purchase process
Full access to the Interactive Map is purchased through the website map.exploremallorca.es itself, following the purchase process enabled for this purpose. The purchase process is available in Spanish, English, German and Italian and is subject to these Terms and Conditions.
The purchase process comprises the following steps:
-
Selection of the access plan and review of the final price including taxes.
-
Reading and express acceptance of these Terms and Conditions, including the waiver of the right of withdrawal set out in clause 5.
-
Entry of payment data and confirmation of the purchase.
-
Receipt of order confirmation by email and immediate activation of full access.
4.2 Price and access period
The price for full access to the Interactive Map is shown on the Website at the time of purchase, with express indication of the total amount including applicable taxes (VAT or others).
The purchased full access is valid until 31 December of the current year in which the purchase is made, regardless of the specific date on which the User completes the purchase. No automatic extensions are made. If the User wishes to maintain access the following year, they must purchase new access when it becomes available.
Example: If the User purchases full access on 15 August 2026, their access will be active until 31 December 2026.
4.3 Payment processing
Payments are processed securely through Stripe Payments Europe, Ltd. (Ireland), in accordance with the Payment Card Industry Data Security Standard (PCI DSS). The Website owner does not store the User's card details.
The payment methods accepted are those shown as available at any given time during the purchase process (credit and debit cards, among others).
Once payment is confirmed, the User will receive a confirmation email and full access to the Interactive Map will be activated immediately.
4.4 Invoicing
The Website owner will issue the corresponding invoice or proof of payment, which will be sent to the email address provided by the User during the purchase process. If the User needs an invoice with specific tax details (tax ID, company name, tax address), they must expressly request this before completing the purchase at support@exploremallorca.es.
5. Waiver of the right of withdrawal
IMPORTANT NOTICE: By completing the purchase of the Interactive Map, the User expressly waives the 14-day right of withdrawal provided for in article 103.a) of Royal Legislative Decree 1/2007, of 16 November (TRLGCU), as it is digital content whose execution begins immediately after payment confirmation and with the User's prior express consent.
In accordance with the provisions of article 103.a) of Royal Legislative Decree 1/2007, of 16 November, approving the consolidated text of the General Law for the Defence of Consumers and Users (TRLGCU), the right of withdrawal shall not be applicable to contracts for the supply of digital content not provided on a tangible medium when execution has begun with the prior express consent of the consumer and with their acknowledgement that they consequently lose their right of withdrawal.
Consequently, during the purchase process, the User:
-
Expressly consents to the execution of the digital service beginning immediately upon confirmation of payment.
-
Acknowledges and accepts that, as the service begins immediately, they lose the right of withdrawal that would otherwise apply under consumer regulations.
-
Confirms that they have read and understand the conditions of the service before completing the purchase.
This waiver is actively and separately obtained during the purchase process, as a prerequisite to payment confirmation.
6. Refund policy
Given the nature of the Interactive Map as a digital product with immediate access, and by virtue of the waiver of the right of withdrawal accepted by the User in the purchase process in accordance with clause 5, no refunds will be made once payment has been processed and access activated.
Notwithstanding the above, the Website owner will individually analyse any complaint related to:
-
Serious technical problems or prolonged service interruptions attributable to the owner.
-
Billing errors (duplicate charges or incorrect amounts).
-
Any other exceptional circumstance that, in the owner's opinion, justifies an alternative solution.
To submit any complaint, the User may:
-
Open a support ticket directly from the website: www.exploremallorca.es
-
Send an email to: support@exploremallorca.es
The User must indicate their full name, purchase email address, transaction date and a detailed description of the reason for the complaint. The owner will respond within a maximum of 15 working days.
7. Affiliation and links to third parties
7.1 Disclosure of affiliate relationships
The Website may include links to third-party platforms (such as Tiqets or other tourist activity platforms) through which the User can purchase tickets, book activities or contract services. Some of these links are affiliate links: if the User makes a purchase through such links, the Website owner may receive a commission from the corresponding platform, at no additional cost whatsoever to the User.
All affiliate links are correctly identified on the Website by means of the indication "[affiliate link]" or an equivalent mention, in accordance with article 20 of Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce (LSSICE) and article 26 of the Unfair Competition Act.
7.2 Editorial independence
The existence of affiliate relationships does not condition or influence the editorial content published on the Website. The Website owner selects and recommends services and activities based solely on criteria of quality and interest for the User.
7.3 No liability for purchases on third-party sites
The Website owner acts exclusively as an advertising intermediary through affiliate programmes. Purchases, bookings or contracts made through third-party platforms (Tiqets or others) are governed exclusively by the terms and conditions of those platforms. The Website owner is not a party to the contract concluded between the User and the destination platform, and assumes no responsibility for:
-
The content, quality or provision of activities or services offered by external platforms.
-
The cancellation, refund or modification conditions of bookings made on third-party platforms.
-
Technical incidents, payment disputes or any complaint arising from purchases on external platforms.
For any complaint related to purchases on third-party platforms, the User must contact the customer service of the relevant platform directly.
7.4 Other external links
The Website may include hyperlinks to other websites for informational purposes. The owner does not control the content of such websites and assumes no responsibility for their availability, accuracy, legality or reliability. The inclusion of a link does not imply recommendation or association with the destination site.
8. Intellectual and industrial property
8.1 Owner's content
The Website and its content — including, without limitation, texts, articles, photographs, graphics, logos, icons, design, navigation structure and source code — are the property of the owner or of the licensors who have assigned the corresponding rights, and are protected by Spanish and international intellectual and industrial property legislation.
The reproduction, distribution, public communication, transformation or any other use, total or partial, of the Website's content without prior written authorisation from the owner or, where applicable, the holders of the corresponding rights, is expressly prohibited.
8.2 Third-party attributions

-
OpenStreetMap cartographic data: © OpenStreetMap contributors. Used under the Open Database Licence (ODbL). More information at: www.openstreetmap.org/copyright
-

-
Visualisation platform: developed by Zoneatlas Oy (Finland).
Third-party trademarks, logos and trade names that may appear on the Website are the property of their respective owners and are used solely for reference and informational purposes.
8.3 User-generated content
To the extent that the Website does not currently provide for the publication of content generated by Users themselves, this clause is suspended and will be updated if such features are incorporated.
9. Limitation of liability
9.1 Accuracy and currency of editorial content
The owner strives to keep the information published on the Website up to date and accurate. However, tourist information (opening hours, prices, availability of activities, beach conditions, establishment services, etc.) may change without notice. The owner does not guarantee the accuracy, completeness or currency of such data and assumes no responsibility for decisions made by the User based on the information published.
The User is advised to verify information directly with the relevant establishments, bodies or service providers before making any decision.
9.2 Accuracy and currency of Interactive Map data
The Interactive Map of Mallorca is exclusively for informational and tourist guidance purposes. The points of interest, routes, categories, descriptions, photographs and other information contained in the Map are published on a purely indicative basis and may not reflect the real, current or exact situation of the indicated locations.
In particular, the owner expressly warns that:
-
Locations, beaches, trails, establishments or other points of interest may have changed name, may be temporarily closed, may have ceased operations or may not be accessible at the time of the visit.
-
Access conditions to certain places (mountain routes, coves, natural spaces, etc.) may vary according to the time of year, weather conditions or the regulations of the competent public authorities.
-
The base cartography uses data from OpenStreetMap and MapTiler, whose accuracy is subject to the conditions of those providers and may contain inaccuracies.
-
The owner does not carry out physical inspections of the locations included in the Map and cannot guarantee that the published information is up to date at all times.
The owner takes the utmost care in the selection and updating of the Map's content and thanks the User for reporting any inaccuracy or outdated information through the ticket system at www.exploremallorca.es or by email at support@exploremallorca.es, with the aim of continuously improving the quality of the service.
9.3 Disclaimer of liability for physical visits
The Interactive Map is a geographical and tourist information tool. The decision to visit any of the locations indicated on the Map is the exclusive responsibility of the User.
The owner assumes no responsibility for damages, accidents, injuries, material losses or harm of any nature that the User or third parties may suffer during or as a result of the physical visit to the locations shown on the Map, including, by way of example and not limitation:
-
Accidents or injuries during outdoor activities, hiking, water sports or other activities at the indicated locations.
-
Damage resulting from adverse weather conditions, uneven terrain, insufficient signage or difficult access.
-
Losses resulting from closed establishments, beaches without services, non-operational attractions or any other change in the actual state of the visited location.
-
Damage caused by animals, flora or other natural elements of the visited environments.
-
Incidents resulting from the User's failure to comply with the safety, signage or specific regulations of the visited location.
The Interactive Map in no way replaces the judgement, prudence and personal responsibility of the User when planning and carrying out their activities. Before visiting any location, especially natural environments, mountain routes or bathing areas, the User must find out about the current conditions of the location, the applicable access regulations and the recommendations of the competent authorities.
9.4 Availability of the Interactive Map
The owner will make their best efforts to ensure the continuous availability of the Interactive Map. However, the service may be interrupted by causes beyond the owner's control, including failures on the Zoneatlas Oy technological platform, connectivity problems or planned maintenance. The owner does not guarantee uninterrupted availability of the service and assumes no responsibility for the damages that such interruptions may cause.
In the event of prolonged service interruptions (over 72 consecutive hours) attributable to the owner or their technology provider, the owner will individually assess the claims of the affected Users, as set out in clause 6.
9.5 Force majeure
The owner shall not be liable for damages or losses caused to the User by non-performance of their obligations when such non-performance is the result of a fortuitous event or force majeure, meaning any unforeseeable, unavoidable and externally caused circumstance beyond the owner's control.
9.6 Quantitative limit of liability
In no event shall the total liability of the owner to the User for any cause related to the Interactive Map exceed the amount actually paid by the User for the contracted access. This limitation shall not apply in cases of wilful misconduct or gross negligence, nor in cases where applicable law does not permit such limitation.
10. User obligations
The User undertakes to use the Interactive Map exclusively for their own personal and non-commercial purposes. In particular, the following is expressly prohibited:

11. Personal data protection
The processing of the User's personal data is carried out in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council, of 27 April 2016, relating to the protection of natural persons with regard to the processing of personal data (GDPR), and Organic Law 3/2018, of 5 December, on the Protection of Personal Data and guarantee of digital rights (LOPDGDD).

The User may withdraw their consent at any time, either through the unsubscribe link included in each communication, or by contacting info@exploremallorca.es. The unsubscription will be effective within a maximum of 10 working days.
The purchase of the Interactive Map does not in itself imply consent to the sending of commercial communications.
13. Modifications to the terms and the service
The owner reserves the right to modify these Terms and Conditions at any time, in order to adapt them to legislative, jurisprudential or functional changes. Modifications will be published on the Website with an indication of the date of the last update.
For Users who have active paid access to the Interactive Map at the time of a substantial modification of the Terms, the owner will notify them of the modification by email at least 30 days in advance. If the User does not accept the new conditions, they may terminate the contract and request a proportional refund of the unused period, calculated from the date of entry into force of the new conditions until 31 December of the current year.
The owner also reserves the right to modify, suspend or totally or partially interrupt the services offered on the Website, including the Interactive Map, with reasonable advance notice to the affected Users.
